Whole Hearted Car Service Limited Master Service Agreement Version 1.0 · Published and effective 1 Nov 2026 If this Agreement is updated, we will notify you by email. The updated version applies to services that begin after it takes effect, and your signature remains valid; you do not need to sign again (Article 29). PART 1 · GENERAL Article 1 · Definitions 1.1 “The Shop” means Whole Hearted Car Service Limited, including its staff and the persons it engages. 1.2 “The Customer” means the person or company that registers with the Shop and instructs it. 1.3 “Authorized Person” means a person acting for the Customer under a Letter of Authorization signed by the Customer. 1.4 “Service & Cost Confirmation” means the document in which the Shop sets out the work, prices and any special terms for a visit, and which the Customer confirms (by signing online, signing on paper, or replying clearly through a Registered Contact). 1.5 “Registered Contacts” means the telephone number, WhatsApp number and email address the Customer has registered with the Shop. 1.6 “In writing” includes paper and electronic form (electronic signature, email, WhatsApp message and the like). Article 2 · Nature and Scope of this Agreement 2.1 This Agreement is the continuing framework agreement between the Shop and the Customer, and the Customer is the contracting party. The Customer agrees to it once, on first registering with the Shop. It applies to every vehicle the Customer later brings to the Shop and to every inspection, diagnosis, repair, parts replacement and related service. It does not need to be signed for each vehicle. 2.2 The Customer agrees to this Agreement in any of these ways: by signing the Shop's Customer Registration Form; by signing this Agreement online; or by confirming a Service & Cost Confirmation. The full text is displayed at the Shop's premises and at jwhcs.com/ServiceAgreement, and a printed copy is available at the front desk. The Customer may read it at any time before agreeing. 2.3 The work, charges, fees and any special commitments for each visit are those set out in the Service & Cost Confirmation, the work order and the confirmation records both parties can keep. Where a matter is expressly covered by a special term, that special term applies. 2.4 The Shop's Service & Cost Confirmations, inspection reports and receipts are all subject to this Agreement. Anyone who confirms a Service & Cost Confirmation (by signing online, signing on paper or replying through a Registered Contact) is treated as having read and agreed to this Agreement. 2.5 This Agreement, together with the Service & Cost Confirmations, work orders, inspection reports, receipts, and the arrival and collection records in the Shop's system, forms the basis of each service. 2.6 This Agreement is made in English and Chinese. If the two versions differ, the English version prevails. PART 2 · REGISTRATION, AUTHORITY AND HANDOVER Article 3 · Registration and Authority to Instruct 3.1 For every vehicle brought to the Shop, the Customer warrants that the Customer has the right to instruct work, confirm charges and arrange collection. Any dispute concerning a vehicle is for the Customer to resolve, and the Shop bears no liability for it. 3.2 The Shop keeps a record for the Customer and a record for each vehicle the Customer brings. When the Customer brings another vehicle later, its details are simply registered; this Agreement does not need to be signed again. 3.3 If the person or company instructing the Shop changes, the new customer must register and sign this Agreement in its own name. A change of plate number, telephone number or nominated contact only requires the registration details to be updated. 3.4 The Shop may ask to see a driver's licence or other identification and the vehicle's Certificate of Registration, and may keep a photograph or copy. 3.5 Tow operators, people dropping off a vehicle on someone's behalf and other third parties do not gain authority to approve repairs, approve additional charges or collect the vehicle just by bringing it to the Shop. 3.6 Costs and losses caused by false information, unauthorized instructions or failure to update details are borne by the Customer who caused them. 3.7 The Shop is responsible only to the Customer who instructs it. This Agreement and any warranty or commitment of the Shop are given to that Customer alone; they do not pass with the vehicle and cannot be assigned to anyone else. Article 4 · Acting for the Customer and the Letter of Authorization 4.1 The Customer may have someone else deal with the Shop on the Customer’s behalf (for example bringing or collecting a vehicle, confirming work or charges, or paying). The Shop may ask for a Letter of Authorization signed by the Customer (the same form is used by individuals and companies), naming the Authorized Persons. 4.2 The Shop may verify authority with the Customer through the Registered Contacts. If authority is unclear or cannot be verified, the Shop may suspend the matters concerned. 4.3 Anything the Shop does in good faith on the basis of a Letter of Authorization, the registered details or the arrangements of a person acting for the Customer is treated as done by the Customer and binds the Customer. 4.4 An authorization remains in force until withdrawn. To withdraw or change it, the Customer must notify the Shop in writing; matters handled before the Shop receives that notice remain valid. 4.5 A company customer may appoint, by a Letter of Authorization signed by the company, the persons who act for it; anything an Authorized Person does is treated as done by the company, and the company is responsible for it. To change or withdraw an Authorized Person, a director or officer of the company must notify the Shop in writing. Article 5 · Drop-off, Collection and Inspection on Collection 5.1 A vehicle is released to the Customer or a person collecting it for the Customer. The person collecting must show identification. If identity or authority cannot be confirmed, the Shop may refuse to release the vehicle, and any delay and Vehicle Parking Fees that follow are for the Customer’s account. 5.2 The Customer should check the vehicle's exterior and the work carried out at the time of collection. Obvious issues such as scratches or dents must be raised with the Shop on the spot, before leaving. Issues raised after the vehicle has left the premises will not be accepted, unless it can be shown that they were caused while the vehicle was at the Shop. 5.3 Keys and remote fobs handed to the Shop are returned on collection. The Shop is not responsible for spare keys, items or codes that were not handed to it. PART 3 · INSPECTION AND REPAIR Article 6 · Existing Condition and Inspection Risk 6.1 The Customer should describe known faults, unusual behaviour, repair history and other relevant facts. Where the Customer does not know something, saying so honestly is not treated as concealment. A Customer who knowingly hides important facts or gives false information is responsible for the resulting extra work, costs and losses. 6.2 That the Customer did not know of a problem, or that the Shop did not notice it on arrival, does not mean the problem did not exist or that the Shop is responsible for it. A normal arrival check is not a full condition assessment and gives no guarantee of the vehicle's history, overall condition or remaining life. 6.3 Inspection findings reflect only what was actually inspected and found at the time, within the agreed scope. They are not a full inspection of the whole vehicle and do not guarantee that every fault will be found. The Shop is not responsible for failing to find a problem that was not inspected, not found, or not yet apparent at the time. 6.4 Inspection and diagnosis carry risk in themselves. To find a fault, the Shop may need to start the engine and run it at idle or higher speed, lift the vehicle, disconnect and reconnect power, read and clear fault codes, dismantle components, carry out pressure tests and road test the vehicle. Parts that are already aged, worn, faulty or close to failure (such as the engine, transmission, starter, alternator, battery, fuel pump, timing belt or chain, cooling system or electronic modules) may fail during normal inspection, leaving the vehicle unable to start or be driven. 6.5 A failure, inability to start or be driven, or damage that results from the vehicle's existing condition while the Shop is inspecting, diagnosing, moving or road testing it in the normal way is a problem with the vehicle itself and is not the Shop's responsibility. Any repair will be quoted and charged in the normal way. 6.6 If a vehicle that was driven or towed to the Shop will not start, cannot be driven or develops a fault while at the Shop, it is not presumed that the Shop caused it. The Shop is responsible only for damage caused directly by its own error or negligence, subject to the limit in Article 19, and whoever claims that the Shop caused it must provide evidence. 6.7 By signing this Agreement the Customer acknowledges and accepts these inspection risks; the Shop does not need to give separate notice or obtain confirmation before each inspection. The Shop accepts vehicles on the basis of the Customer's description at drop-off and does not assess vehicles before accepting them. The Customer's description, including what is said by telephone or WhatsApp, is recorded in the work order's service background. A problem the Customer did not mention is not treated as confirmed absent by the Shop at drop-off. 6.8 That a vehicle could start or be driven before arrival does not mean its internal parts were sound. A problem that appears after inspection, dismantling, a road test or repair is not attributed to the Shop merely because of when it appeared. Article 7 · Scope of Service and Results 7.1 The Shop carries out only the work it has accepted for that visit and the Customer has confirmed. Inspection, diagnosis, fault finding, removal, installation, adjustment and testing are chargeable services in themselves. 7.2 Intermittent faults, hidden faults and faults with several causes may need to be worked on in stages or over several visits; there is no guarantee that every cause will be found at once. 7.3 Unless the Service & Cost Confirmation expressly promises otherwise, the Customer pays for the labour, technical work and materials the Shop actually provides, not for a guaranteed result such as “fixed for sure”, “will not fail again” or “solved in one visit”. 7.4 A Customer who chooses only partial, temporary or budget-limited work accepts that other problems may remain. Faults unrelated to the work for that visit, and work that was not authorized, are not covered free of charge. Article 8 · Authority to Work, Road Tests and Additional Work 8.1 Within the work and charges confirmed for the visit, the Customer authorizes the Shop to carry out the starting, lifting, inspection, removal and refitting, power disconnection, charging, fault-code reading and clearing, adjustment, programming, calibration and testing required, without asking again at each step. 8.2 The Customer agrees that suitably licensed staff may move the vehicle within the premises and road test it as needed; reasonable use of mileage, fuel and battery charge is part of the service. An accident during a road test that is not caused by the Shop's gross negligence is dealt with under the vehicle's own insurance. 8.3 An initial quotation is based on the visible condition and the information available at the time. Hidden damage, related problems and extra materials found after dismantling are quoted separately. 8.4 Any new chargeable item requires the Customer's confirmation. Signing this Agreement on first registration does not approve future charges that have not been specified. 8.5 The Shop may ask the person confirming the charges to sign this Agreement first. A confirmation given by someone who has not yet signed this Agreement is still valid, and that person is treated as having agreed to all of its terms; the instructing Customer remains responsible for the charges. 8.6 If the Customer cannot be reached or a necessary confirmation is not received, the Shop may suspend the work and reschedule. Article 9 · Vehicle Documents, Legality and Safety 9.1 The Customer warrants that the vehicle's registration, insurance and Certificate of Fitness are valid. If any of them has lapsed, the Shop may decline to road test the vehicle or take it onto a public road, and the Customer accepts any resulting limits on the inspection. 9.2 No weapons, ammunition, drugs, flammable or explosive items or other prohibited or dangerous items may be left in the vehicle. If the Shop finds any, it may stop work and call the police, and the Customer bears all consequences. 9.3 Where a vehicle has a serious safety defect, the Shop may advise that it not be used or that it be towed away. If the Customer insists on driving it away, the Customer does so at the Customer's own risk, and the Shop may record the decision. Article 10 · Recommendations, Repairs the Shop Advises Against, and Timing 10.1 Where the Shop finds other faults or safety risks, it may recommend further inspection, repair, stopping use of the vehicle or towing. If the Customer declines or accepts only part of the recommendation, the Customer bears the consequences of the problems left untreated. 10.2 Where the Shop considers that a repair is not advisable (for example, the result is uncertain, it treats the symptom rather than the cause, the part may fail again soon, the cost is not worthwhile, or a larger repair is needed), it will tell the Customer. If the Customer still asks for the repair after hearing that advice, the Shop may carry it out as instructed. 10.3 For a repair the Customer insisted on, the Shop does not guarantee the result and gives no warranty. If the fault remains or soon returns, or the Customer is not satisfied with the result, there is no refund and no reduction of charges already incurred. Any further inspection or repair is quoted and charged separately. This Article concerns the result of the repair; an error in the Shop's own workmanship is dealt with under Articles 18 and 19. 10.4 The Shop's advice against a repair may be written in the notes of the Service & Cost Confirmation or given through a Registered Contact (telephone, WhatsApp or email). If the Customer confirms the Service & Cost Confirmation, or indicates through a Registered Contact after receiving the advice that the work should go ahead, the Customer is treated as having insisted on the repair. A statement in person or by telephone that the Customer accepts the risk has the same effect. 10.5 Work that has been completed and confirmed by the Customer is not refunded because the Customer is unhappy with the result. A Customer who believes the Shop's work was faulty should raise it in writing under Article 30, and the Shop will review it on the basis of actual testing and records. 10.6 Estimated completion times are based on circumstances at the time and may change because of parts supply, shipping, hidden faults, repeated testing, additional work or delays in the Customer's decisions. 10.7 The Shop does not provide courtesy or rental vehicles and is not responsible for rental, transport, lost time or business losses during inspection, repair, parts ordering or waiting periods. Article 11 · Removed Parts 11.1 If the Customer wants removed parts kept, shown or returned, the Customer must say so clearly before work starts and name the parts. If no request is made before work starts, the Shop does not keep removed parts and is not obliged to produce, return or compensate for them afterwards. 11.2 Parts kept at the Customer's request must be collected with the vehicle. Parts not collected within 7 days of collection of the vehicle may be disposed of by the Shop. Article 12 · Customer-Supplied Parts 12.1 The Shop may decide whether to accept new, used, refurbished or modified parts supplied by the Customer, or materials of unknown origin, and may refuse to fit them or stop work if they are clearly unsuitable, unsafe or likely to damage the vehicle. 12.2 The Customer is responsible for the origin, quality, specification, fit and completeness of parts the Customer supplies. The Shop gives no warranty on customer-supplied parts. It provides only the fitting work confirmed and does not guarantee the parts' quality, life or performance after fitting. 12.3 If a customer-supplied part cannot be used, fails after fitting or needs replacing again, the further inspection and fitting are charged again. Returns, claims and disputes with the supplier are for the Customer to handle and do not affect the charges for work the Shop has completed. Article 13 · Outside Specialists 13.1 The Shop may have specialist work such as programming, painting, glass, tyres, machining or towing carried out by outside specialists, and include the cost in the Service & Cost Confirmation. 13.2 Any warranty on outside specialist work is given by that specialist on its own terms. The Shop will help the Customer contact the specialist but gives no separate warranty for that work. Article 14 · Insurance Claim Vehicles 14.1 Where an insurance claim is involved, the Customer remains responsible for paying the Shop's charges. An insurer's approval of a repair is not payment. 14.2 Any amount the insurer does not pay, pays short, refuses, or deducts as an excess or deductible must be paid by the Customer before collection. 14.3 At the Customer's request the Shop may give the insurer quotations, photographs and records, but it does not negotiate with the insurer for the Customer or take responsibility for the outcome of the claim. PART 4 · CHARGES AND PAYMENT Article 15 · Charging Basis and Repeated Work 15.1 Charges follow the labour rates, per-job prices or item prices set out in the Service & Cost Confirmation for the visit. 15.2 Whenever work on the same part or item is actually carried out again, it is charged again according to the number of times it is done and the confirmed rates. Having done it once does not make doing it again free. 15.3 Where work has to be repeated because of incompatible or faulty parts, changed instructions, restarting after cancellation, repeated fault finding, refitting after removal or any other reason, each inspection, diagnosis, removal and refitting, adjustment and test actually carried out is charged, unless the Service & Cost Confirmation expressly states it is free or under warranty. 15.4 A decision not to repair, not every fault being found, the result falling short of expectations, a problem with customer-supplied parts, or the vehicle going to another workshop does not cancel the charges for authorized work actually carried out. Materials used, outside costs incurred and non-returnable parts ordered with the Customer's confirmation must also be paid for. Article 16 · Payment, Deposits and Late Payment 16.1 The Shop accepts cash, card (POS) and bank transfer. All amounts due must be paid before collection. Under the laws of Jamaica the Shop has a lien over a vehicle it has repaired: until all amounts are paid, the Shop may retain the vehicle and refuse to release it, and Vehicle Parking Fees continue to accrue under Article 24 while it is retained. 16.2 Non-payment by an insurer, another payer or a parts supplier does not release the Customer from paying. 16.3 The Shop may ask for a deposit or advance payment for parts. Any balance left after deposits are applied to actual charges is refunded once accounts are reconciled; payment for parts ordered that cannot be cancelled is not refunded. 16.4 If payment is overdue, the reasonable costs of recovering it (including legal fees, collection fees, and towing and handover costs) are for the Customer's account. Article 17 · Cancellation and Reassembly 17.1 A Customer who wants to cancel, pause or move the work elsewhere must tell the Shop promptly and pay for work already carried out. 17.2 Cancellation does not include returning the vehicle to its condition on arrival; the Shop is not obliged to refit or adjust anything free of charge or to ensure the vehicle can be driven away. Restoration, refitting or extra work to prepare the vehicle for towing is quoted and charged separately. 17.3 Because of damage, missing parts, single-use materials or the dismantled state, the vehicle may not be restorable to its original condition, and the Shop does not promise that it can be. If the Customer does not pay for restoration, the vehicle is handed over in its state when work stopped, and the Customer must arrange suitable towing. PART 5 · WARRANTY AND LIABILITY Article 18 · Warranty 18.1 The Shop gives a warranty only on parts it supplies, and only for work for which a warranty is expressly stated in the Service & Cost Confirmation (including its notes), for the period and scope stated. Where nothing is stated, there is no promise of free re-repair, free replacement, service life or mileage, and none arises from anything said, past dealings or custom. 18.2 Parts not supplied by the Shop are never covered by warranty, including parts supplied by the Customer, bought from a third party at the Customer's direction, or taken from another vehicle. The Shop gives no workmanship warranty on fitting such parts either. 18.3 A warranty covers only re-repair or replacement of that item by the Shop. It does not cover towing, courtesy transport, lost time, business losses or any other loss. 18.4 A warranty is void or does not apply in any of these cases: (a) maintenance or checks were not carried out as recommended by the Shop or the manufacturer, or a recommended service interval was exceeded; (b) anyone other than the Shop has dismantled, repaired, adjusted or modified the item, or added to or altered a related system; (c) accident, collision, scraping, driving through water, flooding, fire, lightning, other natural disasters or external damage; (d) misuse, overloading, towing, racing, off-road use, commercial operation or other use beyond normal driving; (e) fuel, oil, coolant, brake fluid or other fluids of the wrong specification, or fluid levels that are low or contaminated; (f) the vehicle was driven on after a warning light, unusual noise or other abnormality appeared, or was not stopped promptly and the Shop contacted; (g) normal wear of wear-and-tear items and consumables, such as brake pads, brake discs, wiper blades, bulbs, fuses, tyres, belts, filters, spark plugs and batteries; (h) electronic components or modules damaged by electrical faults, abnormal voltage or moisture; (i) a fault related to a part the Shop recommended replacing and the Customer declined to replace; (j) a recurring problem in the affected area of a vehicle under an insurance claim, or of a vehicle whose earlier accident damage was not fully repaired; (k) the problem was not reported to the Shop in writing (including by message through a Registered Contact) within the warranty period, or the vehicle was repaired elsewhere instead of being brought back to the Shop for inspection; (l) the charges for that service have not been paid in full; (m) the Service & Cost Confirmation, receipt or other records cannot be verified. 18.5 On noticing a problem, the Customer must stop using the vehicle at once, contact the Shop and bring the vehicle back for inspection. Any additional damage caused by continued use is the Customer's responsibility. 18.6 Whether a problem comes from an existing condition, a part, the way the vehicle was used or the Shop's work is decided from actual testing and records, not from either party's assumptions. A problem appearing after the vehicle leaves the Shop does not in itself entitle the Customer to free inspection or work. Article 19 · Limitation of Liability 19.1 The Shop's total liability for any one service is limited to the amount the Customer actually paid the Shop for that service. 19.2 The Shop is not liable for indirect or consequential losses, including business losses, loss of profit, lost time, rental, transport costs and third-party claims. 19.3 These limitations do not exclude any liability that the law expressly does not allow to be excluded. Article 20 · Customer's Indemnity 20.1 If the Shop suffers a third-party claim, fine or loss because of false information supplied by the Customer, a dispute concerning a vehicle, unauthorized instructions, prohibited items in the vehicle or the Customer's breach of this Agreement, the Customer will compensate the Shop in full, including reasonable legal fees. Article 21 · Events Beyond the Shop's Control 21.1 The Shop is not responsible for delay, failure to perform or loss of or damage to vehicles caused by events beyond its control, such as hurricanes, heavy rain, flooding, earthquakes, fire, power outages, strikes, civil unrest, government orders or epidemics. 21.2 Vehicles at the Shop during such events are dealt with under Part 6. PART 6 · PARKING, BELONGINGS AND UNCOLLECTED VEHICLES Article 22 · Open-Air Parking and the Customer's Protection of the Vehicle 22.1 The Shop's standard parking is an open-air yard. A roof, enclosed garage, controlled environment or attendant is not guaranteed. By leaving a vehicle at the Shop, the Customer accepts the open-air conditions and must arrange the necessary protection against rain, sun, wind, hail and theft, including providing covers and waterproofing. 22.2 Where the vehicle's condition affects its weather-tightness, the Customer must take protective measures. Where work may change the vehicle's protection (for example, removing windows, doors or seals), the Shop may remind the Customer; whether or not the Shop does so, protection remains the Customer's responsibility. 22.3 The same protection requirements apply when a vehicle is allowed to stay free of charge; free parking does not mean the Shop provides storage, security or all-weather protection. A Customer who does not accept open-air parking must arrange other premises and have the vehicle towed away. Article 23 · Parking Risk and the Nature of the Vehicle Parking Fee 23.1 While a vehicle is at the Shop, whether or not a fee is charged, the Shop provides parking space only. The Vehicle Parking Fee is not a storage, security, insurance or protection fee. 23.2 The Customer bears the risk of damage during open-air parking caused by weather, the environment or the vehicle's own weather-tightness, and the risk of theft, vandalism and accidental damage of unknown cause. The Shop does not insure vehicles for the Customer; a Customer who wants insurance must arrange it. 23.3 This Article applies at every stage a vehicle is at the Shop, including between work, while waiting for parts or the Customer's decision, after completion, after cancellation and while overdue. Article 24 · Vehicle Parking Fee and Uncollected Vehicles 24.1 When work is completed or ends, or the Shop asks for a vehicle to be collected, the Shop notifies the collection deadline and the date the Vehicle Parking Fee starts. 24.2 After the notified free period, a Vehicle Parking Fee of J$2,500 is charged for each calendar day. The day the vehicle leaves counts, part of a day counts as a full day, and the fee is not pro-rated by the hour. 24.3 No Vehicle Parking Fee is charged during free work or parts-waiting periods agreed by the Shop. Where the Customer persistently fails to supply parts or confirm a plan, declines the repair or cancels, the Shop will notify a collection deadline and fee start date. 24.4 A dispute about charges, inability to pay for now, not having arranged towing or not having found another place to park does not stop a Vehicle Parking Fee that has started; any extension or reduction must be expressly confirmed by the Shop. 24.5 After the Vehicle Parking Fee has started, if the Shop cannot reach the Customer through the Registered Contacts (no reply, calls unanswered, messages unread or refused) for more than 15 calendar days, the Shop may send a written notice to the Registered Contacts setting a deadline for collection. If the vehicle is still not collected by then, the Shop may report the matter to the police or other authorities and lawfully have the vehicle removed and handed over, after which the Shop has no further obligation to keep or look after it. The Customer remains liable for unpaid charges, Vehicle Parking Fees and reasonable towing and handover costs. Article 25 · Personal Belongings 25.1 Before handing a vehicle to the Shop, the Customer must remove and secure all valuables and personal items, including cash, bank cards, documents, jewellery, phones, computers and other electronics, tools, medicines and papers. 25.2 The Shop does not take custody of items left in vehicles and does not count, record, look for or guard them. The Customer may make no claim against the Shop for loss of, theft of, moisture damage to or other damage to items left in a vehicle. 25.3 Items not removed are left in the vehicle by the Customer's own choice and at the Customer's own risk. Photographs, video, moving the vehicle or looking inside it at drop-off do not mean the Shop has taken custody of, or confirmed the type or number of, any items. 25.4 If items are found in the vehicle during work, the Shop may leave them where they are or gather them inside the vehicle, without any further duty to look after them. PART 7 · INFORMATION, PRIVACY AND COMMUNICATIONS Article 26 · Personal Information and Privacy 26.1 The Shop collects and keeps the information it needs to provide its services, including name, telephone, WhatsApp, email, address, TRN and licence photograph, vehicle details and photographs of vehicle documents, Letters of Authorization, signatures, photographs and video of vehicles and work, and records of services, payments and communications. 26.2 This information is used only to register and verify identity, provide and record services, quote and charge, contact the Customer, deal with warranty matters and disputes, and comply with the law. The Shop does not sell customer information. 26.3 For parts look-up, technical advice, fault diagnosis or reading vehicle documents, the Shop may share Certificates of Registration and Fitness, VINs, vehicle details, photographs, video and fault descriptions with parts suppliers, dealers, technical advisers, other specialist workshops and outside specialists, and with the software, communications and artificial-intelligence service providers the Shop uses. These providers may process the information outside Jamaica. The Shop shares only what is needed for the purpose. 26.4 The Shop also shares necessary information with an insurer when the Customer asks, and with government authorities, the police or the courts when required by law. 26.5 Work orders, photographs, signatures and payment records are kept for 7 years and then deleted or anonymized, or for longer where the law requires. 26.6 The Customer may ask to see and correct the Customer's information. The Shop handles personal information under the Data Protection Act, 2020 of Jamaica; see the Privacy Notice at app.jwhcs.com/privacy. Article 27 · Photographs, Video and CCTV 27.1 The Shop may photograph and film vehicles at drop-off, during work and at collection, and its premises may be covered by CCTV. These records are used to show the vehicle's condition and the work done, and to deal with warranty matters and disputes. 27.2 The Shop does not use photographs that identify a customer for promotion without the customer's written consent. Article 28 · Electronic Signatures, Records and Notices 28.1 The Customer agrees to sign this Agreement, Service & Cost Confirmations and other documents electronically, and electronic signatures have the same effect as handwritten ones. Electronic records kept by the Shop may be used as evidence. 28.2 The Registered Contacts are the channels through which the Shop sends quotations, confirmations, collection, charging and other notices. A notice sent through a Registered Contact is treated as received 24 hours after it is sent. A clear reply from the Customer through a Registered Contact may serve as the record of accepting a quotation, authorizing additional work, cancelling, declining a repair or arranging collection. 28.3 Where an important item or amount is discussed by telephone, the Shop may record it and send a written summary. The Customer must keep contact details and authorized contacts up to date; any suspension or rescheduling caused by out-of-date details or a prolonged failure to reply is the Customer's responsibility. Article 29 · Updates to this Agreement 29.1 The Shop may update this Agreement as its business requires. Updates are sent to the Customer's registered email or published at jwhcs.com/ServiceAgreement, stating the version, effective date and a summary of the changes, with access to the full text. 29.2 The Customer agrees once, on first registration. Later visits, additional vehicles and updates under this Article do not require a new signature. 29.3 A material change concerning new charges, charging rates, the scope of authority or the allocation of responsibility is clearly brought to the Customer's attention and confirmed before the affected service begins; confirmation may be recorded on the Service & Cost Confirmation for that service or given in an electronic reply that can be kept. Notice alone is not confirmation of a material change. 29.4 A Customer who does not accept an update must say so before the service begins, and the Shop may decline that service. Updates do not change orders already confirmed or completed. PART 8 · OTHER MATTERS Article 30 · Complaints and Disputes 30.1 A Customer with a complaint about a service must raise it in writing (including by message through a Registered Contact) within 7 days of collection, stating the facts and what is requested. The Shop will reply within 5 working days of receiving it. 30.2 The parties will first try to settle the matter between them. Failing that, this Agreement is governed by the laws of Jamaica. The parties agree that only the courts of Kingston and St. Andrew, where the Shop is located, have jurisdiction: matters within the jurisdiction of the Kingston and St. Andrew Parish Court are heard by that court, and other matters by the Supreme Court of Judicature of Jamaica in Kingston. The Customer may not bring proceedings in any other court. Article 31 · Conduct on the Premises, Removal and Refusal of Service 31.1 Customers and anyone with them must follow the Shop's directions on its premises, keep out of work areas and not obstruct staff or the Shop's business. 31.2 The Shop may require anyone to leave its premises immediately, and call the police if necessary, for any of the following: abusing, threatening or harassing staff or other customers; deliberately causing trouble, pestering or filming to harass; entering work areas or using the Shop's equipment without permission; drunkenness, fighting or other conduct that disrupts the business or safety. 31.3 The Shop may place a Customer and the Customer's vehicles on a no-service list and refuse all future registration, drop-offs and services for any of the following: the conduct described above; dishonesty, including false information, hiding important facts, deliberately withholding or refusing payment, or payments being returned unpaid; failing to keep to this Agreement; malicious complaints, false claims or threats against the Shop. 31.4 For a Customer on the no-service list, the Shop may stop work not yet completed and charge for the work done. The Customer must pay and collect the vehicle within the time the Shop notifies; after that, Vehicle Parking Fees and Article 24 apply. 31.5 Removal from the premises or placement on the no-service list does not release the Customer from amounts already owed or from liability for losses caused to the Shop. Article 32 · General 32.1 If any provision of this Agreement is found invalid or unenforceable, the remaining provisions are not affected. 32.2 A failure or delay by the Shop in exercising any right is not a waiver of that right. 32.3 Headings are for convenience only and do not affect interpretation.
